A founder from Jaipur called me after a bad experience. His startup had hired a lawyer for DPDP Act compliance. Six months and a big invoice later, he still didn’t have a working privacy policy. “I didn’t even know what to ask him at the start,” he told me.
That’s the real problem. Most founders don’t hire badly because they’re careless. They hire badly because nobody told them which questions to ask. Here are the questions to ask before hiring a compliance lawyer, so you don’t repeat his mistake.
Question 2: Who Will Actually Do My Work?
Many firms send a senior partner to the first meeting. Then a junior associate handles everything after that. That’s not always bad. But you should know upfront.
Ask who your main contact will be. Ask who drafts the documents. Ask who reviews them before they reach you. The answer tells you how much attention your work will really get.
Question 3: How Do You Charge?
Vague billing causes more client complaints than almost anything else. Before you sign, ask whether the lawyer charges a fixed fee, an hourly rate, or a monthly retainer.
Then ask what sits outside that fee. Do drafting revisions cost extra? Does a quick phone call count as billable time? Get the answers in writing. A confident lawyer explains fees clearly and doesn’t dodge the question.
Question 4: How Fast Will You Respond?
Compliance problems don’t wait for a convenient schedule. A breach notice or a customer complaint might land on a Friday evening. You need to know your lawyer will pick up.
Ask about their typical response time. Ask how they handle urgent issues. Then watch how fast they reply to your first few emails. That early behaviour usually predicts the rest.
Question 5: What Will You Give Me in Writing?
This one separates good compliance lawyers from average ones. Verbal advice disappears. Written records protect you if a regulator ever asks what steps you took.
Ask whether you’ll get a written gap report, drafted policies, and a checklist of next steps. Ask if they’ll keep documentation of their advice. A lawyer who says yes without hesitation understands how compliance really works.
One Extra Check: Verify Their Credentials
Don’t skip this step. Confirm the lawyer holds a valid enrolment with their State Bar Council. The Bar Council of India publishes information on how advocates get enrolled and regulated. A quick check takes ten minutes and can save you months of trouble.
Also read their online reviews. Look at how they write about their own work. A lawyer who explains things clearly in public usually explains things clearly to clients too.
Red Flags to Watch During the First Call
Trust your instincts during that first conversation. Watch for these warning signs:
- They promise guaranteed outcomes for regulatory matters
- They can’t explain their fees clearly
- They dodge questions about past DPDP Act work
- They push you to sign quickly without giving you time to think
- They use heavy legal jargon and never simplify
Any one of these deserves a second thought. Two or more usually means you should keep looking.
